WAIVER AND RELEASE OF LIABILITY:

I acknowledge that the exercise, martial arts and fitness programs and the use of the exercise equipment offered through J&M Fitness, LLC DBA Cary Brazilian Jiu-Jitsu ("CBJ") at the Facility or any other location where CBJ operates (the "Center") can provide for strenuous physical exercise, and I am aware of the inherent risk of serious physical injury and other dangers associated with the use of the equipment and the programs. In consideration for CBJ providing me with martial art and fitness training services, I hereby accept and fully assume all such risks and dangers and the possibility of personal injury, disease and illness (including any contagious skin conditions) death, and property damage or loss resulting from such use and participation. I also hereby release, save harmless and indemnify CBJ and all employees and independent contractors at the facility from any and all claims, actions, costs, expenses and demands in respect to death, injury, loss or damage that I or my next of kin may suffer arising out of or in connection with my use of the equipment, my participation in the martial art and fitness programs, due to any cause whatsoever, including without limitation, the negligence of CBJ, the facility and any one or more of the employees of CBJ. I agree that the Release and Indemnity Agreement prior to signing and I am fully aware that by signing this agreement I am affecting my legal rights.

The Member certifies that the Member has, and at all times during the term will have, adequate insurance to cover any injury or damage suffered as a result of attending school classes or participating in the martial arts. alternatively, Member certifies that the Member has, and during the term will continue to have, the means to self insure against such injury or damage. The Member further certifies that the Member has no medical condition which could interfere with the Member’s safe participation in school classes or the martial arts.                                                                      

To the best of my knowledge, I have (and/or my child) has no preexisting physical or mental condition that will be exacerbated or negatively affected by strenuous exercise or close physical contact.                                                                               

I also hereby agree to allow my image (and/or that of my child) in any form including photographs, my (their) voice, and all other depictions, to be used for promotional purposes by CBJ whether in print, internet, or any other medium or media.
